Commission Law Changes by the NAR

effective August 17, 2024

The NAR Commission Settlement is a change in real estate practices aimed at increasing transparency and promoting fairness in how real estate commissions are disclosed and negotiated.

  • Negotiable: Real estate commissions have always been negotiable. This means that buyers and sellers have the flexibility to discuss and agree upon commission rates with their agents.
  • Traditional Payment Structure: Traditionally, it has been the seller who pays the agent commissions. This arrangement has been common because buyers already face significant upfront costs, including the down payment and closing costs.

What’s Changing with the NAR Settlement on August 17, 2024?

  1. Transparency: Under the new NAR settlement, instead of commission details being automatically included in the MLS (Multiple Listing Service) listings, agents must explicitly disclose whether they are offering a buyer commission. Consessions can still be offered on the MLS, especially for Buyer’s Closing Costs.
  2. Buyer Broker Agreement Requirement: In order to go see homes with an agent, a buyer will need a signed agreement with an agent. This agreement acknowledges your representation, the duties your agent will perform, and in some cases, an agreement for future compensation.
